State police arrested a trooper for an alleged drunken driving charge after they have investigated a one-car accident in western New York.

They identified the suspect as 31-year-old trooper, Martin McClellan resident of Rochester who was off duty when he was involved in a crash on Interstate 490 in Gates Town on Feb. 28.

McClellan sustained a broken leg and his BAC was later determined to be 0.18 percent; it was twice the legal limit of 08%.

Last Friday, the trooper was charged with aggravated DUI and was scheduled to have a day in Gates Town Court on March 19.

Police reported that the suspect said he will be extending his sick leave because of his injuries. Officials in the office were mum about his status. McClellan did not give any comment about his case.
